Subsequent to a conviction in Superior Court, an individual may be referred by the Judge to the Probation Department for the preparation of a presentence report. Information contained in these reports includes circumstances of the offense, sentencing recommendations, any victim impact, prior criminal history/probation performance, mental health and/or substance abuse related issues, employment history, familial history, level of personal responsibility for the offense, willingness to participate in treatment if necessary and desire to participate on probation if granted the opportunity. The presentence report helps to guide the court in making an appropriate sentencing decision. Additionally, Deputy Probation Officers compose reports related to illegal firearm ownership pursuant to Proposition 63, as well as investigate an individual’s eligibility for expungement of their criminal records.
