Man Sentenced to Seven Years Prison for Evading Police in Stolen Vehicle

Santa Rosa, CA  –  February 28, 2017  –  Defendant James William Biocca, Jr., 48 years-old of Healdsburg, was sentenced yesterday by the Honorable Peter Ottenweller to 7 years in state prison after pleading no contest on October 13, 2016 to charges of vehicle theft with a prior conviction, fleeing from a pursuing peace officer, driving under the influence of drugs, and possession of methamphetamine.  Biocca also admitted enhancements for having previously served time in prison, and committing a prior “strike” offense.  

District Attorney Ravitch stated, “This defendant’s actions were extremely reckless and incredibly dangerous.  Everyone on the road was in harm’s way due to this brazen conduct.  We sought a greater sentence than imposed, but are pleased that this menace will be off the street for some time to come.”  

The charges resulted from an incident on January 3, 2016, at approximately 2:00 a.m. in which Biocca was driving a vehicle along Healdsburg Avenue in Healdsburg that was reported stolen two weeks earlier.  An officer noticed Biocca’s vehicle speeding and driving erratically and attempted to initiate a traffic stop.  However, instead of pulling-over, Biocca led officers on a 19 mile-long pursuit through Alexander Valley.  Specifically, officers pursued Biocca on Alexander Valley Road, Pine Flat Road, Red Winery Road, Geysers Road, Hwy 128, Chianti Road, and Hwy 101.  During the pursuit, mostly on single-lane country roads, Biocca ran six stop signs, drove on the wrong side of the road, illegally passed vehicles, and reached speeds up to 90 mph.  Biocca finally yielded when a strategically placed spike strip flattened his two front tires.  Upon being contacted, Biocca was found to be under the influence of methamphetamine and marijuana, and was in possession of methamphetamine and marijuana.  

The case was prosecuted by DDA Jessica Washington of the District Attorney’s Vertical DUI Unit.  Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration. The Healdsburg Police Department headed the investigation.
